Alleged Dropped Tool Injury

A scaffolding supervisor claimed he was struck in the head by a pair of tin snips dropped by electricians working above him during a refueling outage at the Pilgrim Nuclear Power Station.

Working for the defendant, Drake -with team attorneys and an OSHA expert - entered the power station during the next outage to document the accident site. Drake produced a scale model detailing the steel structure and relevant building elements such as feed-water heater tanks, stairway, guardrails, toe rails, piping, electrical cable trays and conduits and steel decking of the upper level where the electricians were thought to be working.

During trial the model was used to demonstrate inconsistencies in plaintiff's account of the site and accident. Plaintiff's demand before trial was $9 million; after a short deliberation the jury returned with a verdict for the defense.
